We all need a break from the pressures of everyday life now and again, and a holiday abroad can be the perfect way to relax and live the dream, even if it’s only for a short while. From sun soaked breaks on a white sand beach to adventure holidays in the snow, our idea of relaxation changes from person to person, but one thing we all have in common is that none of us want to lose our dream holiday to accident or illness. Unfortunately, for many holidaymakers that dream can turn into a nightmare that leads them to claim holiday compensation.
Suffering a serious illness or injury abroad can be emotionally devastating. Not only can it ruin your holiday, but going through such a traumatic event in a foreign country can be particularly stressful, even frightening. We also appreciate that these incidents can have a significant financial impact, especially in cases where it becomes necessary to seek costly medical treatment not covered by your insurance.
Claiming for holiday compensation can be a lengthy and difficult process, and how we proceed will depend on the nature of the incident, when and where it occurred, and the injury or illness you suffered. It’s important to make your claim as quickly as possible. For example, package holiday compensation claims for an all-inclusive holiday have to be made within 3 years while other types of claim usually have to be made within two or three years of the incident, depending on the country in which the accident occurred.

It’s always a good idea to start pursuing your claim as soon as possible. Firstly, the events will still be fresh in your mind and medical records easier to access, and secondly, there is a three year time limit placed on holiday claims. This may be shorter depending upon the type of claim you are making and the country in which it occurred, but three years is the standard you should look to.
The three year limit is taken from the ‘date of knowledge’, which is when you first learned your illness or injury was not your fault, but the fault of your holiday provider, airline or other holiday service operator. If you try to bring a holiday compensation claim after this three year period, it will be considered ‘statute barred’ or ‘out of time’ as per the Limitation Act of 1980, section 11. If you are within this time limit, we will advise you as best we can, based upon the information you’re able to share with us.
