Claiming for an accident in a public area

Slips, trips and falls can happen anywhere, but accidents that happen on a public highway such as the street or pavement may be due to lack of maintenance by the local authority or utility company. So you may be able to make a claim for compensation from the relevant organisation responsible for your accident.

Under the Highways Act 1980, local councils have a statutory duty to inspect and maintain all public highways including roads and pavements. So they would be held responsible if your accident was caused by broken paving slabs, potholes, faulty lamp posts or damaged street furniture such as bollards, or even lumps and bumps in the pavement caused by tree roots.

Or you may have tripped over a grid or cover in the pavement owned by a utility company such as the water board, gas company or BT. As these companies also have a responsibility to maintain the public highway, you may also be able to make a claim against them.
